This week, the European Commission has ordered Luxembourg to recover €250 million from Amazon in illegal tax benefits granted to it and has also referred Ireland to the Court of Justice of the EU ("CJEU") for failing to recover from Apple €13 billion in illegal tax benefits which it had granted.
Territorial restrictions in media content licensing – lessons from the Paramount commitments decision
The European Commission's battle against territorial restrictions in media content licences continues on a number of fronts. One of those is an investigation launched in January 2014 into whether a number of US film studios, including Disney, NBC Universal, Sony, Twentieth Century Fox, Warner Bros, and Paramount, have infringed EU competition law by including territorial restrictions in pay TV deals with Sky.
Hutchison's attempted takeover of Telefonica's O2 mobile network in the UK was blocked today (11 May 2016) by the European Commission. Although widely predicted, this decision is the first outright prohibition by the Commission of a 4-to-3 mobile merger in Europe.
